Introduction

The sale of products on our website is governed by these General Terms and Conditions of Sale. Products purchased on www.lagabbianella.com are sold directly by SOLIF srl, with registered office in Italy, via di San Ginese 252/B, 55012 S.Ginese di Compito (Lucca). You may request any information by emailing us at info@lagabbianella.com ..

1. Commercial policy

1.1 SOLIF srl offers for sale on www.lagabbianella.com products and carries out its e-commerce activity exclusively towards its end users who are ‘consumers’.

1.2 When we talk about ‘consumer’ we refer to any natural person who acts on www.lagabbianella.com with purposes not related to his or her commercial, entrepreneurial or professional activity, if any. If you are not a ‘consumer,’ please refrain from entering into commercial transactions through www.lagabbianella.com.

1.3 In view of its commercial policy, SOLIF srl reserves the right not to process orders from parties other than the ‘consumer’ or in any case orders that do not conform to its commercial policy.

1.4 These General Terms and Conditions of Sale exclusively govern the offer, submission and acceptance of purchase orders for products on www.lagabbianella.com between users of www.lagabbianella.com and the Seller.

2. How to finalize the contract with La Gabbianella

2.1 To finalize the contract for the purchase of one or more products on www.lagabbianella.com, you must fill out the order form in electronic format and submit it to La Gabbianella, electronically, following the instructions.

2.2 You can find on the order completion page a link to the General Terms and Conditions of Sale, and a summary of the information on the essential characteristics of each product ordered and its price (including all applicable taxes or duties), the means of payment you may use to purchase each product and the method of delivery of the products purchased, shipping and delivery costs, a reference to the conditions for exercising your right of withdrawal and the manner and timeframe for returning the products purchased.

2.3 The contract is finalized when the Seller receives, electronically, the order form, after verification that the data relating to the order is correct.

2.4 The order will be stored in our database for the period of time necessary to process orders and in any case within the terms of the law and the privacy regulations that you can consult in full at this link.

2.5 In the event of errors or missing data necessary for order fulfillment, you will also be asked to identify and correct any data entry errors before proceeding with the transmission of the order form.

2.6 Once the contract is finalized, Solif srl will take charge of your purchase order.

2.7 Solif srl may not process purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or if products are unavailable. In these cases, we will inform you by e-mail that the contract is not concluded and that Solif srl has not carried out your purchase order specifying the reasons. If the products, presented on www.lagabbianella.com are no longer available or on sale at the time of sending the order form, it will be the responsibility of La Gabbianella to notify you, promptly and in any case within 30 (thirty) days from the day following the day on which you have transmitted your order to the Seller, the possible unavailability of the products ordered. If you submit your order and pay the price, the Seller will refund what you have already paid in advance.

2.8 By submitting your order form electronically, you unconditionally accept and undertake to observe, in your dealings with Solif srl, these General Conditions of Sale. If you do not agree with any of the terms stated in the General Conditions of Sale, please do not conclude the order for the purchase of products on www.lagabbianella.com

2.9 Once the contract is concluded, Solif srl will send you, by e-mail, a receipt of the purchase order, containing a summary of the information already contained in the order form (General Conditions of Sale, Information on the right of withdrawal, the information relating to the essential characteristics of the product and a detailed indication of the price, means of payment and delivery costs).

3. Warranties

3.1 Only original, first-rate products are offered for sale on www.lagabbianella.com. These products are directly handcrafted by Solif srl.

3.2 The Seller does not sell used, irregular or substandard products that are inferior to the corresponding standards offered in the market.

3.3 The essential features of the products are presented on www.lagabbianella.com within each product sheet. However, the images and colors of the products may not match the actual ones also due to the effect of the Internet browser and monitor used.

3.4 Product prices may be subject to updates. Make sure of the final sale price before placing the relevant order.

3.5 Purchase requests from countries not included among those in which shipping is provided cannot be accepted by the Seller.

3.6 The Seller, in case of exercise of your right of withdrawal, has the right not to accept the return of products that have been altered in their essential and qualitative characteristics or that have been damaged.

4. Shipping

4.1 The shipment of products purchased on La Gabbianella is made by courier Tnt / Fedex for the Italian territory.

4.2 Delivery times
ITALY: delivery is usually after a minimum of 10 working days from the processing of the order as each product is handmade by Solif srl at the time of the order. Any delays in delivery may be caused by malfunctions in service by the courier, force majeure or in case of holidays.  If after 15 working days (excluding Saturdays and Sundays) you have not yet received your goods, please contact La Gabbianella customer service at info@lagabbianella.com.

4.3 Costs and fees

 

ITALIA

The cost of shipping varies depending on the total weight of the products purchased, according to the following rates

  • Less than 2 kg: € 10.00
  • Between 2 kg and 5 kg: € 20.00
  • Above 5 kg: € 30.00

5. Payments

You can make payment for purchases on La Gabbianella website in 2 different ways mainly:

1. Credit or prepaid cards (i.e. secure payment in advance): circuits Visa, Mastercard, Nexi (Carta Sì) and PostePay

2. Bank Transfer. Payment is made by Bank Transfer indicating the Order Number as the reason for payment to the following current account

6. Right of withdrawal and returns

6.1 In accordance with art. 5 DL 185/1999, if the customer is a consumer (i.e. a person who buys goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to La Gabbianella a reference of VAT), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without penalty, except as indicated in the following points. To exercise this right, the customer must send Solif srl a communication to this effect, within 14 working days from the date of receipt of the goods.

6.2 Such notice must be sent by email to info@lagabbianella.com. Once we receive the above notice of withdrawal, Solif srl will quickly notify the customer instructions on how to return the goods, which must be received by Solif srl within 10 days of authorization.

6.3 The right of withdrawal is still subject to the following conditions:

– the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased;
– the right does not apply to sealed products once opened;
– the purchased goods must be intact and returned in original packaging, complete in all its parts;
– to limit damage to the original packaging, we recommend, when possible, to put it in a second box, indicating the words ‘RIGHT OF WITHDRAWAL’;
– the sticking of labels or adhesive tapes directly on the original packaging of the product should be avoided in all cases;
– in accordance with the law, the shipping costs related to the return of the good shall be borne by the customer;
– the shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer;
– in case of damage to the goods during transport, Solif srl will notify the customer of the incident (within 5 working days of receipt of the goods in their stores), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
– Solif srl is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;
– upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and / or the original packaging are damaged, Solif srl will deduct from the refund due a percentage, but no more than 10% of it, as a contribution to the costs of restoration. Without prejudice to any repair costs for damages assessed to the original packaging, Solif srl will refund the customer the full amount already paid, within 14 days of the return of the goods, through the transfer procedure of the amount charged. In the latter case, it will be the customer’s responsibility to promptly provide the bank details on which to obtain the refund (ABI – CAB – Current Account of the invoice holder). The right of withdrawal lapses totally, for lack of the essential integrity of the property (packaging and / or its contents), in cases where Solif srl ascertains:

– the lack of the outer packaging and / or the original inner packaging;
– the absence of integral elements of the product;
– damage to the product for reasons other than its transport.

In the case of forfeiture of the right of withdrawal, Solif srl will return to sender the purchased goods, charging him the shipping costs.

7. Time and method of refund

7.1 After returning the products, Solif srl will make the necessary verifications regarding the conformity of the goods. In the event that the checks are concluded positively, Solif srl will send you, by e-mail, the relevant confirmation of acceptance of the products thus returned.
7.2 Whatever mode of payment you used, the refund is activated by the Seller in the shortest time possible and in any case within 30 (thirty) days from the date on which the Seller became aware of the exercise of your right of withdrawal after verification of the proper execution of your right of withdrawal and acceptance of the returned products.
7.3 If there is no correspondence between the recipient of the products indicated in the order form and the person who has made the payment of the sums due for their purchase, the refund of the sums, in case of exercise of the right of withdrawal, will be carried out by the Seller, in any case, to the person who made the payment.
7.4 Shipping for the return shall be borne entirely by you
7.5 The refund will be made in euros and – in the case of shipments from foreign countries – potential changes in exchange rates, customs fees, VAT and duties will not be refunded.

9. Applicable law and dispute resolution

The General Terms and Conditions of Sale are governed by Italian law and, in particular, by Legislative Decree No. 206 of September 6, 2005, on the Consumer Code, with specific reference to the regulations on distance contracts and by Legislative Decree No. 70 of April 9, 2003, on certain aspects concerning electronic commerce.

10. Modification and update

The General Terms and Conditions of Sale are amended from time to time also in consideration of any regulatory changes. The new General Conditions of Sale shall be effective from the date of publication.

However, these Terms and Conditions of Sale are supplemented and complemented by the vertical and specific sections on the site relating to payment methods, returns and refunds, shipping and delivery. You are therefore invited to review all procedures and conditions related to each point.
